RULES AND REGULATIONS FOR CEMETERY CORPORATIONS ACCEEPTABLE TO THE DIVISION OF CEMETERIES

AS BEING A CONFORMANCE WITH THE REQUIREMENT OF THE LAW

RIDGE ROAD CEMETERY ASSOCIATION #28-032

1. All lots in the Ridge Road Cemetery are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any other purposes than as a burial place for dead human beings.

2. No vault or mausoleum shall be built.

3. No monuments or markers shall be permitted which utilize colors other than those of natural stone. All monuments or markers must be constructed of marble, granite or bronze. 

4. No interment shall be allowed without a burial permit first being obtained from the NYS Health Department or other state or government.  The following information must be furnished:

· Name of the deceased

· Age of deceased, if known

· Date of death

· Time and date of interment

· Cemetery to retain on record, burial receipts

5. Lot owners are prohibited from allowing interments to be made on their lots for compensation.

6. Interments in a lot are restricted to those entitled to burial therein according to the terms of the Section 1512 of the Not-For-Profit Corporation Law. The lot owner(s) must file permission for burial of those not entitled to burial according to the said Sections, with the Ridge Road Cemetery Association.

7. Except as provided for in Section 1513c of the Not-For-Profit Corporation Law, no lot owner may transfer his or her lot.

8. Payment for the grave, and payment for the interment shall be accompanied by the burial permit when deceased is brought to the Cemetery for final disposition or storage.

9. A cremation certificate shall be provided for any cremated remains interred or placed in a niche.

10. The display or release of ANY balloon or balloons in the cemetery is strictly prohibited.

11. The Ridge Road Cemetery Association reserves the right to remove all flowers, wreaths, or other decorations from lots as soon as they become unsightly or if they are hazardous to our personal and/or equipment.

12. The Ridge Road Cemetery Association reserves the right to remove, after due notice to the lot owner, any embellishment on the lot, effigy or inscription which, in the opinion of the majority of the trustees or directors, is unsightly or dangerous.

13. The Ridge Road Cemetery Association reserves the right to restrict the planting of shrubs and trees. There will be no rose bushes or any bush/trees with thorns. Upon due notice to the lot owner, the cemetery reserves the right to remove any shrub, tree or overgrown plantings deemed dangerous to the public. 

14. No plantings shall exceed 18 inches from the headstone on the graveside and must be no wider than the width of the stone. No plastic or artificial flowers or plastic ornaments. No hanging decorations, including but not limited to bird feeders, wind chimes, shepherd hooks etc. All winter decorations may be placed after November 15th and must be removed by April 1st.

15. Funerals must be at the Cemetery by 1:30 pm in order that work persons will have sufficient time to properly close the grave and remove equipment before 2:30 pm

16. All funerals, processions and vehicles will be under the control of the superintendent and/or his designee while in the Cemetery.

17. Only one monument shall be allowed on a lot and it shall be set in accordance with the general plan of the Cemetery and shall conform to said plan in size and material. The only exception would be Veteran markers.

18. All work done in the Cemetery shall be done by Cemetery employees or under the control of the superintendent or board of directors.

19. Heavy trucking or other vehicular traffic shall be refused entrance to the Cemetery when, in the opinion of the superintendent, injury to roads and driveways might result. The maximum size allowed would be a 10-person passenger vehicle.

20. All persons shall be allowed access to the Cemetery during daylight hours, observing the rules that are in effect and the propriety due the Cemetery.

21. Disinterment’s will be allowed between May and October, provided the provisions of Section 1510(e) of the Not-For-Profit Corporation Law are complied with. 

22. Cemetery Board Directives 201.8 and 201.12 will govern interments on Saturdays, Sundays and Holidays.

23. Graves will not be opened when weather conditions warrant such refusal. Bodies received for interment during this time will be buried when weather conditions allow.

24. All lot owners are required to notify the Cemetery of any changes of address. All notices required to be sent, shall be sent to the last recorded address and such notices shall be deemed adequate.

25. All bodies left in the vault after May 1st will be removed and interred. If not entitled to a burial in a family plot, they will be interred in a single grave. The expense of such interment shall be borne by those who caused the body to be placed in the vault. Only such notice shall be given in this case as shall be practical under the circumstances.

26. All bodies brought in for storage must be embalmed.

27. Cremated remains will not be permitted to be scattered in any part of the Cemetery.

28. Concrete vaults or concrete grave liners will be required for interments in all graves purchased after January 1, 1985, in accordance with the provisions of Cemetery Board directive 201.6.

29. The interment of cremated remains will be permitted only in appropriate rigid receptacles such as metal or concrete vaults. 

30. The Directors of Ridge Road Cemetery Association may amend these Rules and Regulations, but no such amendments shall be effective until approved by the New York State Cemetery Board.

COLUMBARIUM POLICY & ADDENDUM TO RULES AND REGULATIONS  

1. Ownership & Rights

All columbarium units are the property of Ridge Road Cemetery Association. The purchase of a niche grants the right of inurnment, not ownership of the niche itself.

2. Niche Use

Each niche is designated for human cremated remains only. The number of urns permitted per niche will be determined by the cemetery based on niche size. Only properly processed cremated remains may be placed in a niche.

3. Opening & Closing

All openings and closings of niches must be performed or supervised by cemetery personnel. Scheduling must be arranged in advance through the cemetery office. Applicable fees will be charged according to the current fee schedule.

4. Lettering & Engraving

Lettering/engraving is not included in the purchase of a niche. Families may select any qualified monument provider. All engraving must be approved by the cemetery prior to work and conform to columbarium design standards.

5. Design Standards

To preserve uniformity and dignity, only approved fonts and layouts may be used. Emblems or additional designs must receive prior written approval. No attachments or alterations may be made to niche fronts.

6. Approved Providers

The cemetery maintains a list of preferred providers familiar with columbarium specifications. Families may choose any qualified provider who complies with cemetery requirements.

7. Vendor Requirements

All outside monument providers must provide proof of liability insurance, submit design proofs for approval, schedule work through the cemetery, and comply with all cemetery rules.

8. Liability

The cemetery is not responsible for damage caused by outside vendors. Vendors are responsible for repair or replacement of any damage to cemetery property.

9. Decorations & Maintenance

No permanent decorations or attachments are permitted on niche fronts. Temporary items may be restricted or removed at the cemetery’s discretion.

10. Cremains Certificate

A cremation certificate must be provided for any remains entombed in a niche.

11.  General Provisions

All fees are subject to change without notice. The cemetery reserves the right to amend these rules as necessary. All purchasers and vendors agree to comply with these policies.
